Terms of sale.

These Terms of Sale apply only where a member separately purchases an object through NURVANA, including an object sourced following a member request or another product transaction expressly stated to be governed by these Terms.

They do not govern membership fees, joining a release or allocation of an object through a release, except where a specific fulfilment provision is expressly stated to apply.

These Terms supplement the NURVANA Terms of Service. If specific transaction terms displayed before purchase conflict with these Terms, the specific transaction terms apply to the extent of the conflict.

NURVANA NETWORK PORTAL L.L.C. (Nurvana) operates a portal connecting members with curated objects and independent product partners. Objects may be sourced, held, sold and/or fulfilled by independent partners.

The identity and role of the applicable seller, where required, will be disclosed before or in connection with purchase.

Nothing in these Terms makes Nurvana the owner or seller of an object where the applicable transaction identifies an independent partner as seller.

Product information may include brand, model, material, colour, size, condition, provenance, authentication information, imagery and other relevant details.

Nurvana may rely on information provided by the applicable product partner together with any verification undertaken for the transaction.

Pre-owned, vintage or archive objects may show signs of age, storage, handling, repair or prior use consistent with the condition disclosed. Images are intended to represent the object reasonably but screen settings and photography may affect appearance.

Third-party brand names and trademarks are used for identification of genuine products and do not by themselves imply affiliation, sponsorship or endorsement by the applicable brand.

A sourcing request is an instruction to search for an object and is not itself an order, purchase or guarantee of availability.

If an object is located, the member will receive the material commercial information applicable to the proposed purchase before being asked to confirm the transaction.

The price of a sourced object may reflect prevailing market price, availability, condition, provenance, partner pricing, logistics and other transaction-specific factors.

A sourcing quotation may be time-limited and remains subject to availability until the transaction is confirmed.

The purchase price and currency applicable to an object will be displayed or otherwise communicated before purchase.

Any shipping charges, duties, taxes or other mandatory charges collected by Nurvana at checkout will be identified where required.

Where duties, import taxes or other destination charges are not collected at checkout, the member may be responsible for them where permitted by law and disclosed before purchase.

Any stated market, retail or reference value is informational and may vary over time and by source. It does not constitute a guarantee of current resale price or future value.

Submitting payment or an order request does not necessarily mean that an order has been accepted.

A transaction becomes binding when the applicable seller confirms acceptance or the Platform otherwise communicates that the purchase has been confirmed, subject to mandatory law.

An order may be declined or cancelled before confirmation because of object unavailability, verification concerns, pricing or listing error, payment failure, legal restriction, suspected fraud, sanctions concerns or another material reason preventing lawful fulfilment.

Payment must be made using a payment method accepted by the Platform.

Payment services may be provided by independent payment processors and may be subject to their security and verification requirements.

Nurvana may conduct or request reasonable payment, identity, fraud, sanctions or compliance checks before confirming or fulfilling a transaction.

Nurvana and/or the applicable product partner may undertake authenticity and condition review appropriate to the object and transaction.

Any specific authenticity commitment, certificate, third-party verification or condition report applicable to an object will be stated in the product information or transaction confirmation.

No description of condition should be understood as meaning that a pre-owned or archive object is free from all signs of age or use unless expressly stated.

Objects may be fulfilled directly by an independent product partner or through a logistics provider.

Delivery method, destination availability, estimated timing and applicable charges may vary by object and destination.

Delivery dates are estimates unless expressly guaranteed. Nurvana is not responsible for delay caused by customs, authorities, carrier disruption, incorrect delivery information, force majeure or other circumstances outside its reasonable control, except to the extent liability cannot lawfully be excluded.

Risk and title pass at the time required by the applicable transaction terms and mandatory law.

Products may not be available for delivery to every country.

A transaction may be restricted where required by sanctions, export controls, customs rules, brand restrictions, carrier limitations or other legal or operational constraints.

The member is responsible for providing accurate destination and customs information. Mandatory destination-country consumer rights remain unaffected where they apply.

Cancellation and return rights may vary according to the seller, object, transaction type, destination and mandatory consumer law.

The applicable return or cancellation information will be disclosed before purchase where required.

Nothing in these Terms removes a statutory cancellation, return, refund, repair, replacement or other remedy that cannot lawfully be excluded.

Except where a return or refund right is expressly offered or required by law, confirmed purchases may be final. Any returned object must satisfy the applicable return conditions communicated for the transaction, to the extent those conditions are lawful.

If an object arrives materially damaged, is not the object ordered or materially fails to conform to the description or mandatory legal requirements, the member should notify Nurvana promptly with reasonable supporting information.

Nurvana and/or the applicable seller will assess the matter and provide the remedy required by the transaction terms and applicable law.

An object allocated to a member through a Nurvana release is not purchased by that member and no additional purchase price is payable for the allocated object.

Release eligibility, participation, allocation and the member's right to receive an allocated object are governed by the Terms of Service and any specific release terms communicated for the applicable release.

These Terms of Sale apply to an allocated object only where a specific fulfilment, delivery, authenticity, condition or consumer-law provision is expressly stated to apply or is required by mandatory law.

A release allocation does not create an obligation for the member to purchase the allocated object.

Nurvana does not guarantee the future resale price, market value, liquidity, appreciation or investment performance of any object.

Products and allocated objects are intended for personal acquisition and enjoyment and should not be treated as financial investments.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

To the maximum extent permitted by law, Nurvana is not liable for indirect, incidental, special or consequential loss or for losses caused solely by an independent seller, carrier or other third party outside Nurvana's legal responsibility.

Any transaction-specific liability limitation is subject to mandatory consumer law.

Nurvana may decline, suspend or cancel a purchase transaction where reasonably necessary to investigate suspected fraud, unauthorized payment, sanctions concerns, identity misuse, resale abuse or other unlawful activity, subject to applicable law and any refund obligations arising from cancellation.

These Terms are governed by the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates, without prejudice to mandatory consumer protections that cannot lawfully be displaced.
